Environmental compliance in property preservation is not optional — it is a legal requirement backed by significant penalties. Preservation vendors work on properties spanning every era of construction, and older properties frequently contain regulated materials that require specific handling protocols. Lead paint, asbestos, mold, and other hazardous materials are common in the distressed and vacant properties that make up preservation portfolios. This guide covers the environmental regulations that affect preservation work and the compliance protocols vendors must follow.
Lead-Based Paint and the RRP Rule
Lead-based paint is present in approximately 87 percent of homes built before 1940 and in a significant percentage of homes built through 1978. The EPA's Renovation, Repair, and Painting (RRP) Rule requires that any work disturbing painted surfaces in pre-1978 housing be performed by EPA-certified firms using certified renovators who follow lead-safe work practices.
When the RRP Rule Applies to Preservation Work
- Scraping or sanding painted surfaces during board-up preparation or cosmetic repairs
- Replacing windows, doors, or trim that involves disturbing painted surfaces
- Demolishing painted walls, cabinets, or built-in components during debris removal
- Any work that creates paint chips, dust, or debris from pre-1978 painted surfaces
- The rule applies when more than 6 square feet of interior surface or 20 square feet of exterior surface per project will be disturbed
RRP Compliance Requirements
- The preservation firm must be EPA-certified (or state-certified in states with authorized programs)
- At least one certified renovator must be assigned to each job
- Work areas must be contained to prevent dust and debris spread — plastic sheeting, sealed doorways, and covered HVAC vents
- Lead-safe work practices must be followed: no open-flame burning or torching, no uncontained power sanding or grinding, HEPA vacuum for dust cleanup
- Cleaning verification must be performed after the work using either a cleaning verification card or dust wipe sampling
- Records of compliance must be maintained for three years
Asbestos Regulations and Handling
Asbestos-containing materials (ACMs) are present in many properties built before 1980. While intact asbestos materials that are not disturbed generally do not pose a risk, any disturbance — cutting, breaking, sanding, or demolishing ACMs — releases fibers that cause serious lung disease and cancer.
The EPA's NESHAP (National Emission Standards for Hazardous Air Pollutants) regulations govern asbestos in buildings. Before any renovation or demolition activity that could disturb suspected ACMs, a certified asbestos inspector must assess and test the materials. Only licensed asbestos abatement contractors may remove confirmed ACMs, following strict containment, removal, and disposal protocols.
Common Asbestos-Containing Materials in Preservation Properties
- 9-by-9-inch floor tiles and associated mastic adhesive
- Pipe insulation, especially on heating pipes and ductwork
- Popcorn or acoustic ceiling texture applied before 1980
- Transite (cement-asbestos) siding and roofing shingles
- HVAC duct insulation and flexible fabric connectors
- Vermiculite attic insulation (may contain asbestos from the Libby, Montana mine)
Mold Identification and Remediation
Mold is one of the most common environmental issues in vacant properties. Without climate control, humidity levels in vacant buildings rise quickly — particularly in southern and coastal states. Mold can establish itself within 24 to 48 hours of water intrusion or sustained high humidity.
EPA guidance distinguishes between small-scale mold (under 10 square feet) that trained maintenance personnel can address, and larger contamination requiring professional remediation. Many states have additional licensing requirements for mold remediation companies. Regardless of scale, the remediation sequence is the same: identify and correct the moisture source, contain the affected area, remove contaminated materials, clean remaining surfaces with appropriate methods, and verify the remediation was successful.
- Never paint over mold — paint does not kill mold and will peel as the colony continues to grow
- Never use bleach on porous surfaces as a remediation method — it does not penetrate the material and the mold returns
- Always identify the moisture source before remediation — leaks, condensation, groundwater intrusion, or failed weatherproofing
- Document mold conditions with photographs and moisture readings before and after remediation
- Dispose of mold-contaminated materials properly — typically double-bagged in 6-mil plastic
Other Hazardous Materials
Preservation vendors encounter additional hazardous materials beyond lead, asbestos, and mold. Each requires specific handling.
- Abandoned chemicals: Pool chemicals, pesticides, solvents, and fuels found in garages, sheds, and utility rooms. Do not move or dispose of unknown chemicals — document and report for professional hazmat disposal
- Mercury: Found in older thermostats, fluorescent light tubes, and some switches. Handle as hazardous waste — never place in regular trash
- Refrigerants: HVAC systems and refrigerators contain regulated refrigerants. Units must be professionally decommissioned with refrigerant recovery before disposal
- Underground storage tanks: Occasionally encountered on residential properties (former heating oil tanks) and frequently on commercial properties. USTs are regulated by EPA and state agencies and require professional assessment and removal
- Biological hazards: Needles, animal carcasses, and human waste are encountered in distressed vacant properties. Handle with appropriate PPE and dispose through proper biohazard channels
Building an Environmental Compliance Program
Environmental compliance should be systematic, not ad hoc. Preservation vendors should maintain current EPA and state certifications, train all field personnel on hazard recognition, establish clear stop-work protocols for unexpected environmental findings, document all environmental decisions and actions, and maintain relationships with certified testing and abatement subcontractors. Compliance costs money upfront but is far less expensive than penalties, litigation, and cleanup costs from non-compliance.
